I think we should agree in such cases to make it available as an option. It doesn't hurt as you'd have to pay points for it anyway, and makes it possible to not take it - both alternatives viable interpretation.
Same thing came up yesterday I think.

Would appending some kind of marker to name of non strict choice help?

So, to sum up in one place, a new policy would be (if we agree):
If in doubt, implement the option that might be illegal, instead of denying users option to build possibly legal roster - but in such a case that:
RAW is most probably wrong or the choice is vague or problematic, suffix the entry name with appropriate marker from the following (including parentheses)
- [RAW VAGUE]
- [RAW ILLEGAL]
- [RAW PROBLEMATIC]
This might also be applied to rules which create raw-strictness issues.
